Ordinance #287: Regulating peddlers, hawkers, itinerant merchants and vendors (1963)

An ordinance of the Borough of Darlington regulating peddlers, hawkers, itinerant merchants, and vendors of merchandise in the Borough; declaring it to be obnoxious and a business offensive to the inhabitants for those engaging in such pursuits to go in or upon private residences without having been requested or invited to do so, and providing penalties for the violations thereof.

Be it enacted and it is hereby enacted and ordained by the Town Council of the Borough of Darlington as follows:

Sec. 1. That the practice of going in and upon private residences in the Borough of Darlington, Beaver County, Pennsylvania, by solicitors, peddlers, hawkers, itinerant merchants or invited to do so by the owner or owners, occupant or occupants of said private residence for the purpose of soliciting orders for the sale of goods, wares and merchandise, and/or disposing of, and/or peddling or hawking the same is hereby declared to be obnoxious and a business offensive to the inhabitants, and it is further declared to be a nuisance and punishable by summary of conviction.

Sec. 2. That any or all persons violating the provisions of this ordinance or failing to comply therewith, shall, upon conviction thereof, in a summary proceedings before the Burgess or a Justice of the Peace of the Borough be subject to a fine not exceeding the sum of One hundred ($100.00) Dollars with costs of prosecution for each violation, and in default thereof, shall be subject to imprisonment as provided by the Pennsylvania Borough Code. All fines shall be paid to the Treasurer of the Borough.

Sec. 3. That the provisions of this ordinance shall not apply to the sale, or soliciting of order for the sale, of milk, dairy products, vegetable, poultry, eggs or other farm and garden produce as far as the sale of the commodities named herein is now authorized by law.

Sec. 4. All ordinances or parts hereof in force at the time that this Ordinance shall take effect and inconsistent herewith are hereby repealed.

Sec. 5. This ordinance shall take effect five (5) days after its advertisement in accordance with the law.
