An ordinance of the Borough of Darlington, Beaver County, Pennsylvania, implementing the “Pennsylvania Sewage Facilities Act” (known as Act 537, approved January 24, 1966, P.L. 1535) within the Borough of Darlington, Beaver County, Pennsylvania, by re quiring a permit, imposing a fee for issuance and providing for inspection.
Be it ordained and enacted and it is hereby ordained and enacted by the council of the Borough of Darlington, County of Beaver, and Commonwealth of Pennsylvania.
Sec. 1. All provisions of the Pennsylvania Sewage Facilities Act, (P.L. 1535) are here by incorporated into this ordinance by reference therein with the same force and effect and with the same validity as though the said Act had been written in its entirety herein, with the exertion, however, of the provisions contained herein where the requirements of the Act had been extended by this ordinance.
Sec. 2. No person shall install an individual or community sewage disposal system or construct any building in which an individual or community sewage disposal system is to be installed within the Borough of Darlington, County of Beaver and Commonwealth of Pennsylvania without first obtaining a permit from the proper appointed representative of Borough Council indicating that the site, plans, and specifications of such system are in compliance with the Pennsylvania Sewage Facilities Act of 1966 (P.L. 1535) as the same may be amended from time to time, and with the rules and regulations promulgat ed and adopted by the Pennsylvania Department of Health under and pursuant thereto.
Sec. 3. A fee in the sum of One Hundred ($100.00) Dollars shall be paid to the Bo rough Council at the time of making application of the Permit, which fee in subsequent years may be subsequently be revised by resolution.
Sec. 4. That in the event that any existing sanitary sewage disposal system, or any sewer system hereinafter constructed, is not properly maintained, is permitted to mal function, is permitted to overflow onto the surface, is pumped onto the surface, is ditched, piped or drained to the surface in any storm drain, ditch, waterway or run or otherwise create a health hazard, the user or the persons causing such public health hazard or nuisance shall be deemed in violation of this ordinance.
The Borough Secretary or their duly authorized representative of the Borough Council shall, upon written notification by the Borough Council, have the authority to give written notice to the offending person to apply for a permit when required and correct such violation in accordance with said permit within a specified time or such violation shall be deemed a separate violation each day such violation is permitted to continue.
Sec. 5. The Borough Council shall, from time to time, alone and in conjunction with other Municipalities and/or Townships, appoint an inspector to be the Sewage Enforce ment Officer and shall have the power to issue, deny, or revoke permits, issue notices or orders of violations, make or cause to be made, such inspections and tests that may be necessary to carry out the provisions of this ordinance and the Pennsylvania Se wage Facilities Act of 1966.
Sec. 6. Any person, firm or corporation violating the provisions of this ordinance shall be subject to a fine of not less than $100.00 or more than $300.00 and in default the reof, shall be confined to the Beaver County Jail for a period not exceeding thirty (30) days.
Sec. 7. All ordinances or parts of this ordinance inconsistent with the provisions of this ordinance be and the same are hereby repealed.
