ORDINANCE NO. 353-07: An Ordinance Establishing A Curfew for Minors

AN ORDINANCE OF THE BOROUGH OF DARLINGTON, BEAVER COUNTY, PENNSYLVANIA, ESTABLISHING A CURFEW FOR MINORS UNDER EIGHTEEN YEARS OF AGE AND PROVIDING FINES AND PENALTIES FOR VIOLATIONS THEREOF.

BE IT ORDAINED AND ENACTED and it is hereby ordained and enacted by the Council of the Borough of Darlington, County of Beaver and Commonwealth of Pennsylvania as follows:

SECTION 1.   It shall be unlawful for any parent to permit or any minor person under eighteen years of age to be or remain in any public place or privately owned establishment open to the public for the purpose of business, amusement or entertainment, with the Borough of Darlington between the hours of 11:00 pm and 6:00 a.m., prevailing time, unless accompanied by a parent, upon an errand or legitimate business directed by a parent, or unless engaged in gainful, lawful employment, in which case such minor person shall carry written identification, evidence of employment, or a written statement signed by a parent or shall provide the same to the police protection agency for Darlington Borough within a reasonable period of time to be determined by said police.

SECTION 2. It shall be unlawful for any person operating any establishment open to the public for the purpose of business, amusement or entertainment to permit a minor under the age of eighteen years of age to be or remain upon the premises of said establishment when such minor is in violation of Section 1 hereof.

SECTION 3.   Any minor in violation of this ordinance shall thereupon either be taken into custody by the police and a parent notified to come and remove the minor, or shall be taken or instructed to proceed directly to his or her home. The police thereafter shall cause a written notice to be delivered to the minor(s) parent(s) advising of the violation of this ordinance by a minor shall be kept by the police department.

SECTION 4.   The Chief of the Police Protection Agency servicing the Borough is hereby authorized from time to time to promulgate such rules; and regulations, including the extension of hours for special occasions, as shall be necessary or useful in the enforcement of this ordinance.

SECTION 5. In this ordinance the following definitions shall apply:

  1. “Parent” means the natural parent or guardian or adult person twenty-one years of age or over, responsible for the custody or care of any minor.
  2. “Public Place” means any public street, highway, road, alley, park, playground, vacant lot or land, public buildings, railway station, bus terminal or similar place.

SECTION 6. Any parent who shall permit a minor to violate the provisions of Section 1 hereof after having received a notice of prior violation, or any minor after a first violation of said Section 1, or any person in violation of Section 2 hereof, shall upon conviction of each offense in a summary proceedings be sentenced to pay a fine of not less than Twenty-five, ($25.00) Dollars nor more than Six Hundred ($600.00), Dollars, or in default of payment of fine and/or costs, be committed to the county jail for a period not in exceeding thirty days.

SECTION 7. This ordinance shall be effective five days after adoption, and all ordinances or parts of ordinances inconsistent herewith are hereby repealed insofar as they are inconsistent with the terms of this ordinance. The provisions of this ordinance shall be severable, and if any part hereof hold to be unconstitutional or illegal, such decision shall not affect the validity of the remaining provisions thereof.
