An ordinance prohibiting children under the age of sixteen years from loafing, loitering or being upon any of the public street, alleys or highways of the Borough of Darlington after the hour of nine o’clock p.m., Eastern Standard Time, and providing penalties for the violation thereof.
Be it enacted and ordained by the Town Council of the Borough of Darlington, and it is hereby enacted and ordained by authority of the same:
Sec. 1. It shall be unlawful for any child under the age of sixteen years to loaf, loiter or be upon any public street, alley or highway of the said Borough of Darlington after the hour of nine o’clock p.m., Eastern Standard Time, unless such child is accompanied by his or her parent or guardian, or other adult person having the care and custody thereof.
Sec. 2. It shall be unlawful for any parent, guardian or other adult person having the care and custody of any child under the age of sixteen years to permit such child to loaf, loiter or be upon any public street, alley or highway of the said Borough of Darlington after the hour of nine o’clock p.m., Eastern Standard Time.
Sec. 3. Any person violating the provisions of Section 2 of this Ordinance, upon conviction before the Burgess or any Justice of the Peace of said Borough, shall pay a fine not exceeding Five ($5.00) Dollars and costs of suit, and in default of the payment of such fine and costs, may be committed to the Borough lock-up for a period not exceeding seventy-two (72) hours.
Sec. 4. It shall be the duty of all police officers of the Borough of Darlington to enforce the provisions of this Ordinance be and the same are hereby repealed.
Ordained and enacted into an Ordinance by the Town Council of the Borough of Darlington this 5th day of June, A.D. 1947.
