An ordinance vacating a portion of Third Street and a portion of Martin’s Alley in the Borough of Darlington, County of Beaver and Commonwealth of Pennsylvania.
Whereas, there has been presented to the Town Council of the Borough of Darlington, Beaver County, Pennsylvania, a petition for the vacation thereof, signed by all of the owners of property abutting on the portions of the street and public alley hereinafter vacated.
Now, therefore, be it enacted and ordained by the Town Council of the Borough of Darlington, Beaver County, Pennsylvania as follows:
Sec. 1. All that portion of Third Street lying between the westerly lines of Morris Street and extending westward to the original westerly line of the Borough of Darlington, and all that portion of Martin’s Alley extending from a point 86.53 feet south of the southerly line of Third Street, northwardly to the southerly line of Emmery’s Alley, all as laid out in the original Plan of the Borough of Darlington, Beaver County, Pennsylvania, said portions of said street and said alley being more particularly bounded and described as follows:
- a) Beginning at a concrete monument when the southerly line of Third Street interacts the westerly line of Morris Street; thence by the southerly side of said Third Street south 88° 30′ west, 132.09 feet to a concrete monument on the easterly side of Martin’s Alley; thence by the easterly side of said alley south 1° 30′ east, 86.53 feet to a point; thence south 88° 30′ west, 12 feet to a concrete monument on the westerly side of said Martin’s Alley; thence by the westerly side west, 132.09 feet to a point on the original Borough line, said point being the westerly of said alley, north 1° 30′ west, 86.53 feet to a point on the southerly side of said Third Street; thence by the southerly side of said Third Street south 88° 30′ west, 09 feet to a point on the original Borough line, said point being the westerly extremity of Third Street; thence by said Borough line north 1° 30′ west, 55.00 feet to the northerly side of said Third Street; thence by the northerly side of said street, north 88° 30′ east, 132.09 feet to a point on the westerly side of said Martin’s Alley; thence by the westerly side of said alley, north 1° 30′ west,
141.19 feet to a point on the southerly line of Emmery’s Alley; thence along the southerly line of Emmery’s Alley, north 88° 30′ east, 12.0 feet to a point on the easterly side of said Martin’s Alley; thence by the easterly side of Martin’s Alley, south 1° 30′ east, 141.19 feet to a concrete monument on the northerly side of said Third Street; thence by the northerly side of Third Street, north 88° 30′ east,
132.09 feet to a concrete monument on the westerly side of Morris Street; thence by the westerly side of Morris Street across Third Street, south 1° 30′ east, 55.00 feet to a concrete monument at the place of beginning, be and the same are hereby vacated and discontinued as to any rights of the public therein.
Sec. 2. All ordinances or parts of ordinances inconsistent with the provisions of this ordinance be and the same are hereby repealed.
