Ordinance 111: Authorizing Execution with Chester General Contracting

An Ordinance authorizing the execution of a contract with the Chester General Contracting Company for the improvement of an additional width of Market Street and Second Street, in the Borough of Darlington, County of Beaver and State of Pennsylvania.

Whereas, the State Highway Department of the Commonwealth of Pennsylvania has let a contract to the Chester general Contracting Company for the reconstruction and improvement of a portion of Route No. 204, of the width of eighteen (18) feet, and

Whereas, a portion of said Route traverses Second Street and Market Street, and

Whereas, more than two-thirds of the owners of property fronting on said Market Street and Second Street presented a petition to the Town Council, praying that Second Street be paved and improved to the width of twenty eight (28) feet, and Market to the width of thirty-four (34) feet, and

Whereas, the Town Council, by Ordinance No. 108, did provide for the grading, curbing, guttering and paving of Market Street and by Ordinance No. 109, for the grading, curbing, guttering and paving of Second Street, within the limits mentioned and expressed in said Ordinances, and

Whereas, the State Highway Department of the Commonwealth of Pennsylvania, in advertising for bids did provide that the Borough of Darlington should have the right to enter into a contract with the successful bidder for the grading, curbing, guttering and paving of such additional width of said streets as the municipal authorities would determine.

Now, therefore, be it enacted and ordained by the Town Council of the Borough of Darlington, and it is hereby enacted and ordained by the authority of the same.

Sec. 1. That the proper officers of the Borough of Darlington be and they are hereby empowered in enter into a contract with the Chester General Contracting Company for the guttering, paving, improving, etc. of the additional width of the aforesaid streets, as set forth in the aforesaid ordinances, at the unit prices and upon the same terms as provided in the contract between the said Chester General Contracting Company and the State Highway Department of the Commonwealth of Pennsylvania.

Enacted and Ordained into an Ordinance by the Town Council of the Borough of Darlington the 20th day of June, A.D. 1921.
