Ordinance #272: Regulating Parking and Traffic Flow (1954)

An Ordinance of the Borough of Darlington, regulating parking and the flow of traffic, providing for speed limits; and providing penalties for violation thereof.

Pursuant to the authority contained in the Motor Vehicle Code and in the Borough Code, the Town Council of the Borough of Darlington does hereby enact and ordain as follows:

Sec. 1.

Speed Limit: The Town Council of the Borough of Darlington shall from time to time designate by resolution the streets, roads, highways and alleys situate within the Borough which shall have a speed limit of thirty-five (35) miles an hour and those which shall have a speed limit of twenty-five (25) miles an hour; and shall cause signs designating the said speed limits to be erected along the said roads, streets, alleys and highways in accordance with the provisions of the Motor Vehicle Code. Its shall be unlawful for any person to operate or drive a motor vehicle on any roads, streets, alleys, or highways situated in the Borough of Darlington at a speed in excess of the speed limit designated by resolution of Council and duly posted as provided herein.

(         Sec. 2.

Parking: It shall be unlawful for any person to park any vehicle in front of any private or public driveway, or on any Borough sidewalk or foot path within the Borough of Darlington, or to park a vehicle in such a manner as to block the entrance to, or exit from any such driveway. It shall also be unlawful to park any vehicle on or al.ong the side of any road, highway street, or alley in the said Borough which the Borough Town Council may from time to time, by resolution, designate as a “No Parking” area or zone, and which area, zone or street shall be posted by “No Parking” signs or other appropriate markings as designated by resolution of the Town Council.

Sec. 3.

Stop Signs: Any person operating a motor vehicle on any road, highway, street, or alley within the Borough of Darlington shall bring such motor vehicle to a complete stop within a reasonable distance before entering the intersectionwith a through highway or street, when said road highway, street or alley intersection is posted with an official “Stop” sign as provided in the Motor Vehicle Code. Such official “Stop” signs regulating intersections shall be erected at such intersections and shall regulate the flow of traffic in such manner as the Town Council may from time to time by resolution designated.

Sec. 4. It shall be lawful for the Borough of Darlington to place any pedestals, post signs, lights, wires, or other fixtures or apparatus on, under, or over the streets, roads,

(      highways, and alleys in said Borough for the control and direction of traffic and for designating maximum weights upon such streets, roads, or highways in accordance with the Motor Vehicle Code: and upon such streets, roads, highways, or alleys as shall from time to time be designated by resolution of Town Council.

Sec. 5. Any person, firm or corporation violating the terms of this Ordinance shall be subject to a fine of not less than Five ($5.00) Dollars nor more than One Hundred ($100.00) Dollars for each violation of the Ordinance; and it is further provided that this ordinance shall be enforced in the manner set forth in the Borough Code.

Sec. 6. All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent that they are inconsistent with this Ordinance.
