Ordinance #305: Uniform Standards for Mobile Homes 1975

An ordinance of the Borough of Darlington, Beaver County, Pennsylvania, establishing and enforcing uniform standards governing installation of mobile homes, changes or alterations to mobile homes, or mobile home parks; construction and installation and changes or correction for septic tanks, absorption bed or cesspool system; prescribing fees for permits; providing penalties for the violation of any of the terms or requirements of this ordinance.

Be it enacted and ordained by the Town Council of the Borough of Darlington, Beaver County, Pennsylvania, and it is hereby enacted and ordained by the authority of the same as follows:          ·

Sec. 1. Permit required 

From and after the adoption of this ordinance, it shall be unlawful for any person, firm or corporation to install or place upon, or permit to be installed or placed upon his land within the Borough any mobile home or house trailer for human use or occupancy with first making application to and securing a permit for the Secretary of the Borough, paying the permit fee of Twenty-five ($25.00) Dollars upon making application and upon receiving the trailer permit complying with all of the terms and provisions hereafter provided relating to the sanitary sewage system. Application of permit shall be on the form furnished by the Borough Secretary and the applicant shall furnish all information requested as to type of installation, alteration or addition, the size thereof, floor space area, character of material, estimated total cost of sanitary sewage system, location and owner of the property upon which the installation as to be made. Both the land owner and contractor doing the alteration or addition, and person making installation of a mobile home or house trailer shall be responsible for compliance herewith in securing the permit.

Sec. 2. Plumbing facilities and sanitary sewage disposal system

From and after the adoption of this Ordinance it shall be unlawful to install any mobile home or house trailer for human habitation or use without providing for inside plumbing, facilities and a sanitary sewage disposal system for every such installation, material improvement on addition involving additional toilet or bath facilities even though such structure is fabricated or manufactured elsewhere, whether mobile or immobile, and is erected and placed upon a plot of land in the Borough and intended to be used or occupied either permanently or temporarily for either dwelling, commercial or industrial purposes.

Sec. 3. Sewage Disposal System Permit, Design and Requirements

No person shall install an individual sewage disposal system or place any mobile home or house trailer in the Borough in which an individual or community sewage system is to be installed, without first obtaining a Sewage Disposal System Permit from the Borough Secretary and paying the designated fees at such time, indicating the site plans and specifications of such system are in compliance with the Act of Assembly of January 24, 1966 (being Act No. 537) and known as “Pennsylvania Sewage Facilities Act” and the rules and regulations of the Department of Health adopted pursuant to the said Act, The Environmental Protection Agency or any other existing authority at such time and any such subsequent amendments thereto.

Sec. 4. Plot. Unit Size and Occupancy Regulations

 No mobile home or house trailer shall be placed on a plot of land measuring less than sixty (60) feet by one hundred twenty (120) feet or a total area measurement of less than seven thousand two hundred (7,200) square feet. Nor more than one (1) trailer shall be placed on any plot with a total area of less than one-half(½) acre, or twenty­ one thousand seven hundred eighty (21,780) square feet and no more than two (2) trailers on any designated plot of ground as specified on Darlington Borough map. No two (2) units per plot shall include a mobile unit on a site where a house exists. Any

mobile home or house trailer to be installed shall have a minimum of four hundred eighty (480) square feet of living space and no more than one (1) immediate family shall occupy any one (1) unit.

Any house on any existing lot destroyed by damage may be replaced by a mobile home or house trailer if the owner so desires with proper permit.

Sec. 5. Installation Requirements

All mobile homes or house trailers shall be installed upon and securely fastened to a frost free foundation with footer and in no event shall it be erected on jacks, loose blocks or other temporary materials. All wheels must be removed.

Sec. 6. Removal and Replacement thereof

Any existing mobile home or house trailer once removed from any site shall not be replaced unless all regulations of this ordinance are complied with.

Sec. 7. Safety Regulations and Inspection

All units must comply with governmental safety regulations, and must be open to inspection by proper officials of the Borough.

Sec. 8. Permit Fees

A fee in the sum of twenty-five ($25.00) dollars for a mobile house permit plus the current rate of Sanitary Sewage Disposal System Permit shall be paid to the Borough Secretary for the use of the Borough, at the time of making application for mobile home permit as required in Section 1 of this ordinance and a Sanitary Sewage Disposal System Permit as required in Section 3 of this ordinance. The Sanitary Sewage Disposal System Permit fee and the Borough Enforcement Officer shall be designated by resolution from time to time adopted by Borough Council.

Sec. 9. Display of Permits

No installation of construction as above defined shall be made or commenced without first obtaining the permits herein required and upon receipt of the permits; said permits shall be prominently displayed on the installation being made or remodeled or added to immediately upon receiving the permits or as soon as any part of the installation or structure is on the property and shall then remain so displayed for a period of ten (10) days. If the permits be destroyed or mutilated, without fault of the holder thereof, then the Borough Secretary shall, upon request issue duplicate permits without additional cost.

Sec. 10. Violations and Fines

Any person or persons who shall violate or fail to comply with any of the requirements and provisions of this ordinance, or regulations promulgated there under, or who resists or interferes with any officer or employee of the Borough in the performance of his or her duties shall upon conviction thereof, before any District Magistrate, be liable to a fine of not less than Twenty-Five ($25.00) Dollars and costs and not more than One Hundred ($100.00) Dollars and costs for each and every offense and in default thereof shall be confined in the County Jail for a period of not more than thirty (30) days.

Whenever a person shall have been notified by Borough Council or it’s duly authorized representatives in writing that he or she is committing a particular violation of this Ordinance then each day such violation shall continue after delivery of said notification

shall constitute a separate offense.

Sec. 11. The provisions of this Ordinance shall become effective as provided in the Borough Code.
