Ordinance #342-97: An Ordinance Amending Ordinance 312 Building Permit

An Ordinance of the Borough of Darlington, Beaver County, Pennsylvania, amending certain sections of Ordinance No. 312, which pertains to the requirement of a Building Permit for construction, reconstruction, enlargement, alteration or relocation of any building or structure.

Be it ordained and enacted by the Council of the Borough of Darlington, County of Beaver and Commonwealth and it is hereby enacted and ordained by the authority of the same, that the following section of Borough Ordinance No. 312 are hereby amended and supplemented to include as follows:

Sec. 9.   Requirements of Building Permit

No person shall cause or permit any building to be razed or demolished, or partly razed or demolished, upon any property owned by that person or upon any round rented by him, without first having obtained a building permit therefore under this permit. Said permit shall be issued by the Borough upon filing a building permit application and payment of a fee as stated in Section 9 of said ordinance. Said fee shall be based upon the estimated cost of said proposed demolition or razing of said building but in no event shall the same be any less than $20.00.

Any such person who demolishes or razes, or partly demolishes or partly razes any building under a permit granted hereunder shall comply with all provisions of both state and local law including the regulations of any water and/or sewage provider. Said compliance shall include but not be limited to the following.

Proper disconnection of any water and/or sewer lines so as not to cause any adverse effect on any adjoining properties. No burning of any debris shall be permitted on the premises. No material or debris are permitted to remain on the premises but are to be hauled away from the area within a reasonable period of time. No withstanding any other sections of this ordinance, any demolition and razing done pursuant to any such permit shall be completed within sixty (60) days of its commencement; otherwise said permit shall become invalid.

Sec. 8   Exhibition and Duration of Permit

Said section is hereby amended to state that any building permit, other than a permit issued for the demolition and razing of a building, shall be valid for a period of twelve (12) months from the date of issuance. In all other respects said section shall remain the same to the extent not inconsistent herewith.
